The Gujarat High Court has reportedly modified bail conditions to allow foreign travel for Yogesh Patel, an accused in a 2022 case involving alleged unregistered medical practice in Patan.
Patel is accused of misusing another person’s MBBS degree and posing as an MD physician to run a critical care hospital. The case relates to Prasiddh Hospital in Patan.
Justice S J Dave passed the order on January 30 while hearing an Interlocutory Application filed by Patel. The application sought modification of bail conditions imposed by the High Court on November 11, 2022.
Patel, through his advocate Pratik Barot, requested permission to travel to Canada. He said he needed to attend a family “house-warming ceremony” and also “accompany his minor nephew” to meet the child’s parents.
As per the submissions recorded by the court, Patel said he is “required to attend a house-warming ceremony in Canada in May 2026, at his brother-in-law’s residence.” He also sought permission to “accompany his brother-in-law’s minor son… aged 8 years, who has been residing and studying with the applicant for the past two years, so that the child may meet his parents.”
The original bail conditions required Patel to surrender his passport and not leave the limits of Ahmedabad city until completion of the trial.
Assistant Public Prosecutor Hardik Mehta opposed the application. After considering the submissions, the court “partly allowed” Patel’s plea.
In its oral order, the High Court modified both conditions. The court stated that the condition of surrendering the passport would be kept “in abeyance till December 31, 2026.”
The order further, published by a media house, said, “Therefore, the Trial Court is directed to handover the passport to the applicant forthwith with a liberty to leave India. On return of his journey, the applicant will surrender the Passport before the Trial Court forthwith.”
The court also directed Patel to submit his travel details. “The applicant will produce his itinerary and complete address with the telephone number of his stay in Canada before the Trial Court,” the order said.
Patel was arrested in July 2022 following an FIR registered after an inspection by the Medical Council of Gujarat and the Health Department.
The inspection at Prasiddh Hospital found that Patel had allegedly misused the MBBS registration number of another person. His own Medical Council registration number was also found to be allegedly fabricated.
A detailed investigation was carried out by the District Health Officer and the Taluka Health Officer. A complaint was registered at the Patan A-Division Police Station.
The FIR invoked Indian Penal Code Sections 304, 465, 467, 468, 471, 336 and 201. It also included Sections 30 and 33 of the Gujarat Medical Practitioners Act, which prohibit medical practice by unregistered persons.
