HC Seeks State Govt’s Reply Over Man “Missing” After  Arrest In 2020

In a habeas corpus petition filed by a woman from Bardoli Bariya village in Surat Metropolitan Region, the Gujarat HC on Friday, has sought an explanation from the state government and the Gandhinagar district SP. The woman, Savitaben Chauhan (45) has alleged that her husband, Jibaji Chauhan, was arrested by Dahegam Police two years ago over a minor brawl in the village. There has been no news since. 

Naming assistant sub-inspector Rameshgiri Goswami, Savitaben stated that her husband was taken to the PS on March 21, 2020. Despite repeated pleas before higher authorities and village councils, nothing was done. Her husband remained “missing.” 

Her counsel, Radhesh Vyas, also argued the police version of the narrative which claims that Jivaji was produced before an executive magistrate at Dahegam. In a U-Turn on its own report, the police papers also mention that the accused in the village scuffle was untraceable and hence, A-Summary was filed in the FIR against Jivaji. 

“Given the dateline of the case, the woman was faced with multiple challenges. Two days after her husband was picked up, the lockdown was imposed. Thereon, fears of contracting covid tied her efforts at the grassroot level. She also lost their only child last year,” added Vyas. 

The court directed the government lawyer to ensure its response by January 16.
