Mohammed Irshad Ansari, a resident of Gomtipur, Chartoda, Karabrastan, has petitioned the Gujarat High Court to prevent the demolition of his mother’s grave. As part of a road expansion project, the Ahmedabad Municipal Corporation (AMC) has designated the burial, as well as a number of stores and residential buildings for demolition.
Ansari is one of 41 petitioners who moved court. He has asked the court in his plea to order AMC to refrain from demolishing his mother Habibunnisa’s cemetery, which is located inside the approved demolition zone. Ansari frequently visits his mother’s grave to offer prayers after she died during the COVID-19 epidemic in 2020.
The other petitioners have objected to AMC’s plans to demolish houses and shops near the Chartoda graveyard wall as part of the town planning scheme implementation to widen the road in the Gomtipur area.
The Chartoda kabrastan is owned and managed by the Ahmedabad Sunni Muslim Wakf Committee. The occupants of the 241 structures, including two mosques, houses, and shops, claim the land belongs to the Committee and they have been paying rent. The petitioners have argued that AMC lacks jurisdiction to evacuate them without proper eviction notices.
