Principal Charged With Raping Differently-Abled Teacher Acquitted

The Rajkot sessions court acquitted a school principal who was charged with raping a differently-abled school teacher. The court observed that false complaints with serious allegations are dangerous for men.

The court also directed the city police commissioner to conduct a departmental inquiry into the officers investigating the case. A report would have to be submitted to the court when the inquiry was completed. 

Special judge J D Suthar acquitted Ratu Chavda, who was charged in August 2015 after the differently-abled teacher lodged a complaint with the Mahila police station in the city. 

The prosecution case was that the teacher alleged that the school principal, knowing she was differently-abled, raped her. She alleged that the principal threatened to transfer her and kill her husband and son. The police arrested Chavda, and two police officers filed the chargesheet against the accused in court.

False information?

The defence lawyer mentioned that the complainant had provided false dates of the incidents. The complainant’s husband is a lawyer, but in his affidavit, he claimed to be unemployed. In her complaint, she alleged being raped during recess, but the time of recess described by her is different from the actual time.

The two police officers told the court that they could not find any independent evidence supporting the complainant’s case. They had detained the accused without verifying evidence. 

The statements of other teachers and villagers, recorded by the police, did not support the complainant’s case. These statements were not forwarded to senior officials before filing the chargesheet.

The court, in its order, noted that “It’s not possible the act was committed with the victim as described by her. I have to note with pain, the victim being handicapped getting all the benefits she gets under the law, took the support of the law, gathered the sympathy and misused the law by making serious accusations like rape which is very serious for men.”

The court directed the complainant to pay Rs 1,000 to the Chavda as compensation.
