“Preserve CCTV Footage”, Gujarat State Information Commission Tells Police

The Gujarat State Information Commission’s office has asked the police that the CCTV footage be properly preserved if an RTI application is filed within 30 days of the incident.

This is in response to an RTI application filed by one Satish Aljibhai Vaghela. He had sought CCTV footage from Sheharkotda Police Station in Ahmedabad. He had sought CCTV footage of the alleged misconduct against him by the police.

The footage was denied to him on the grounds of “technical fault”.

The Commission has asked the police to strictly follow an earlier order of the General Administrative Department that has laid down guidelines to give the CCTV footage.

The Commission warned that the State Public Information Officer (PIO) and the First Appellate Authority (FAA) will be liable for penalty and disciplinary action under Section 20 of the RTI Act if they fail to provide the footage, said Pankti Jog of Mahiti Adhikar Pahel.

It further said that if an RTI application is received within 30 days of an incident, the CCTV footage must be preserved. It issued a stern warning that the failure to do so will lead the Commission to initiate proceedings for disciplinary action under Section 20 of the RTI Act and appropriate action under the Gujarat Civil Services (Discipline and Appeal) Rules, 1971.
