The Gujarat High Court has issued a notice in a petition challenging the election of recently elected BJP Rajya Sabha MP Rajeshbhai Parmanandbhai.
The notice was issued on October 1, 2026, by Justice S.V. Pinto, after an election petition was filed against Rajeshbhai’s election. The petition has been filed by Tusharbhai Chaudhary, Leader of the Congress Legislative Party.
At the centre of the petition is an allegation concerning the affidavit submitted by Rajeshbhai along with his nomination papers.
According to the petition, Rajeshbhai stated in his affidavit that no criminal case was pending against him. However, the petitioner has claimed that a criminal case had already been registered against him under Sections 406, 420, 465, 467, 468 and 471 of the Indian Penal Code (IPC).
The petition further states that Rajeshbhai had received a summons in connection with the case after the offences were registered.
It has also been submitted that Rajeshbhai had approached the Gujarat High Court seeking quashing of the complaint through a quashing petition. According to the petition, no stay had been granted by the court in that matter.
The petitioner has therefore alleged that the criminal case was not disclosed in the election affidavit despite Rajeshbhai being aware of the proceedings.
On this basis, the election petition has sought cancellation of Rajeshbhai’s election to the Rajya Sabha.
The petition was argued before the Gujarat High Court by advocates Shaktisinh Gohil and Chintanbhai Champaneri, appearing for the petitioner.
The court has now issued summons/notice in the matter.
