The Gujarat High Court has questioned why Pakistani Hindu migrants living in India were not identified and reported much earlier if authorities believed they were staying in the country without valid permission. The court observed that timely action by government agencies could have prevented the legal complications that have now reached the judiciary.
The observations came during the hearing of petitions filed by Pakistani Hindu families living in Gujarat, many of whom have been waiting for Indian citizenship for several years.
Citizenship Applications Have Been Pending Since 2018
The case is linked to Pakistani Hindu families who fled Pakistan after allegedly facing religious persecution and sought refuge in India. Many of them settled in Gujarat and applied for Indian citizenship in 2018.
However, despite filing their applications years ago, many are still waiting for a final decision. During this period, they have continued to live in India, raising families, working, and becoming part of local communities while their citizenship applications remain pending.
The High Court observed that had the authorities reported these individuals at the appropriate time, the present legal dispute may not have arisen.
Court Questions Verification Process
The bench also questioned the role of the investigating agencies responsible for verifying the applicants.
The judges asked why the authorities failed to complete proper background checks and identity verification despite having enough time. According to the court, if the verification process had been carried out efficiently, the matter would not have become so complicated.
The High Court stressed that government agencies are expected to act promptly in cases involving foreign nationals and citizenship applications instead of allowing them to remain unresolved for years.
‘Why Were They Allowed to Stay for So Long?’
One of the strongest observations made by the court was about the long delay in taking action.
The bench remarked that if the authorities genuinely believed these individuals were living in India illegally, they should not have been allowed to remain in the country for several years without any action. Instead, officials should have immediately reported the matter and initiated the legal process.
The judges questioned why the authorities waited for years before raising objections. According to the court, timely reporting could have prevented many of the issues that have now reached the High Court.
The court further observed that when government agencies fail to act promptly, such cases become increasingly difficult to resolve, especially after the individuals involved have spent years living in India while their legal status remains uncertain.
Religious Persecution Cannot Be Ignored
The petitions before the court state that the applicants are Pakistani Hindus who entered India after facing religious persecution in Pakistan.
Seeking safety and a better future, many of these families settled in Gujarat and have lived here for years. During this time, they have established their lives, found employment, educated their children, and become integrated into society.
The High Court noted that while legal procedures must be followed, humanitarian concerns also deserve careful consideration in cases involving people who have sought refuge from persecution.
Gujarat Has a Large Population of Pakistani Hindu Migrants
According to the submissions before the court, Gujarat is home to one of the largest populations of Pakistani Hindu migrants in the country.
Thousands of such migrants have settled across different parts of the state after leaving Pakistan. Many continue to wait for Indian citizenship or other legal clearances, making the outcome of these cases important for several families.
Court Seeks Balance Between Law and Humanity
During the hearing, the Gujarat High Court made it clear that national security and legal procedures cannot be ignored. At the same time, the court said humanitarian issues must also be considered, particularly in cases involving people who have sought shelter in India after facing persecution.
The bench emphasized that authorities must carry out timely reporting, proper verification, and faster decision-making to ensure that such matters do not remain pending for years and eventually turn into prolonged legal disputes.

The court’s observations have highlighted concerns over delays in administrative action, the handling of citizenship applications, and the responsibilities of government agencies. At the same time, the proceedings have underlined the need to strike a balance between enforcing immigration laws and addressing the humanitarian circumstances of people who have sought refuge in India.
