40 Years For Justice, Now Pension Cuts: Gujarat’s Retired Teachers Back In Court

For a group of retired teachers in Gujarat, the legal battle for a higher pay scale appeared to have finally ended in 2022. After nearly four decades of fighting for their dues, the teachers received salary cheques, including interest, handed over personally by then Chief Justice Aravind Kumar. Now, years later, some of these elderly teachers are facing a fresh battle as the state government seeks to recover the money.

The Gujarat government’s Education Department has issued recovery notices to Tulsibhai Patel and 52 other retired teachers who had received higher pay scale benefits. The department has also reportedly started deducting money directly from their pensions, forcing the teachers to approach the Gujarat High Court once again.

For teachers who have spent much of their lives seeking what they believed they were entitled to, the deductions have reopened a dispute they thought was settled.

From a decades-long fight to relief in 2022

The teachers had spent around 40 years pursuing their claim for higher pay scale benefits. The prolonged legal fight eventually brought them relief in 2022, when the matter reached a significant point in the Gujarat High Court.

Then Chief Justice Aravind Kumar summoned state officials to his courtroom and personally handed over salary cheques to the teachers. The payments included interest, marking the end of a long wait for the retired educators.

By then, many of the teachers were already elderly. Some of those affected by the present recovery proceedings are now around 90 years old.

The cheques represented money the teachers had fought for through decades of legal proceedings. However, the Education Department’s latest action has brought the same dispute back into focus.

Pension deductions bring the dispute back to court

The recovery notices and deductions from pensions have prompted the retired teachers to return to the Gujarat High Court. They are now seeking to protect the benefits they received after years of litigation.

For senior citizens who depend on their pensions after retirement, deductions can have a direct impact on their finances. In this case, the teachers are once again required to pursue legal remedies over payments they had already received following the earlier court proceedings.

The dispute raises questions about the Education Department’s decision to recover the money and how that move relates to the proceedings that led to the teachers receiving their dues in 2022.

A long fight, followed by another legal battle

The case has taken the retired teachers through two very different stages: a long struggle to secure higher pay scale benefits and, now, a fresh challenge to retain the money paid to them.

For Tulsibhai Patel and the other affected teachers, the latest proceedings mean that a fight that began decades ago is not yet over. Despite receiving their dues after a prolonged legal battle, they are once again before the High Court as the government seeks to recover the payments.
