Court Orders Elderly Couple To Visit US To Handover Child To Mother

Gujarat High Court has ordered a Mehsana based elderly couple to visit the US and hand over the custody of their five-year-old grandchild to their daughter. The daughter had immigrated illegally and settled there so returning to India is a very slim possibility.

The woman had filed for the interim custody of her child in a US-based court a year ago. After she gained the case in her favour she moved to Gujarat High Court to secure custody. In 2021, the high court had to hand over the child’s custody to his maternal grandparents. Yet the woman was insistent on getting her son back to her. She kept requesting the assigned lawyer to ensure that her son reached the US. On further questioning, the couple was found to have passports and were to file for US Visa on a priority basis.

This case involves a couple from the Mehsana district who had immigrated to the US on an illegal basis. A few years later they had a son who was sent to India for proper care. A year later the couple parted their ways and the woman got the child’s custody. After an argument, the paternal grandparents took the child with them. Two years later, at the request of the woman, the High Court ensured that the child’s custody remained with the maternal grandparents. The order also mentioned that the child would be more comfortable with his maternal grandparents than a stranger.
