Senior Citizen Couple Take Divorce Fight To Court

A 72-year-old man and a 65-year-old woman have been embroiled in a divorce case since 2006. The matter has been referred to a bench of the Gujarat High Court after an attempt for mediation failed and both the parties couldn’t reach a compromise.

The man is a medical practitioner. He has sought divorce and also challenged an order issued by the Family Court awarding alimony of Rs 20,000 per month to his wife. The couple has two married children.

The couple married 41 years ago in 1980 as per Hindu rites. Four years after their marriage, the couple got into a dispute. The matter reached Gujarat HC in 2017 after the Family Court rejected the petition filed by the man seeking divorce and awarded his wife alimony of Rs 20,000.

As per case details, the dispute started when the woman allegedly left her husband to live separately. She filed a case for maintenance in 1985. They, however, reached a compromise later. As per the settlement, the man started living separately in a rented accommodation and gave monthly alimony to her.

The man later sought divorce from her alleging cruelty and constant quarrels with him. On her part, she alleged that her husband is involved in a relationship with another woman.

After a decade of litigation, the Family Court rejected the plea filed by the husband and awarded monthly maintenance to the woman. The award has been challenged in the HC.
