Gujarat Govt Forms Committee to Assess UCC; Opposition Says ‘Diversion’

The Gujarat government has announced the formation of a five-member committee to assess the necessity of a Uniform Civil Code (UCC) and submit the report within 45 days. 

Chief Minister Bhupendra Patel made the announcement on Tuesday at a press conference along with Minister of State for Home Harsh Sanghavi, Additional Chief Secretary (Home) M K Das, and Law Secretary P M Raval.

The committee will be chaired by former Supreme Court Justice Ranjana Desai. Other members include retired IAS officer C L Meena, senior advocate R C Kodekar, former vice-chancellor of Veer Narmad South Gujarat University Daxesh Thakar, and social worker Gitaben Shroff.

“This committee will conduct a thorough study of all aspects and submit its report in 45 days. The state government will then take an appropriate decision based on its findings,” Patel said.

The decision follows the Gujarat government’s 2022 approval of a committee to explore the feasibility and necessity of a UCC in the state. The proposed Uniform Civil Code aims to establish a unified set of personal laws applicable to all citizens regardless of religion, gender, or sexual orientation.

Minister Sanghavi said that the committee would consult various stakeholders, including religious leaders from all communities. 

He cited Uttarakhand’s implementation of a Uniform Civil Code as a model, saying, “The Uttarakhand government has provided a framework for UCC in the country, and it does not affect the tribal communities.”

Uttarakhand recently became the first state to implement a Uniform Civil Code, regulating marriage, divorce, inheritance, and live-in relationships. The UCC Act, 2024, applies to all residents of the state except Scheduled Tribes notified under Articles 342 and 366 (25) of the Constitution and communities protected under Part XXI. The Act bans polygamy and child marriage and aims to simplify and streamline legal processes related to marriage.

Reacting to the development, Aam Aadmi Party (AAP)’s Gujarat unit President Isudan Gadhvi criticised the move, saying, “Many aspects of the UCC pose a threat to traditional culture. The Maldhari community has unique customs, and the tribal community follows polygamy and other traditions.”

He claimed that the BJP would struggle to win tribal seats in Gujarat due to this decision and accused the party of prioritising the UCC over economic issues. “If the UCC negatively impacts various communities, AAP will oppose it,” he added.

Congress MLA Imran Khedawala also raised concerns about the composition of the committee, pointing out the absence of Muslim representatives. “The committee has been formed, but a draft will be prepared later and presented to the public. It is essential that Muslim leaders and other minority communities have a say in this process,” he said.

He warned that if the draft failed to consider all communities’ perspectives, legal action would be pursued.

Gujarat Congress spokesperson Manish Doshi accused the BJP of using the UCC to divert attention from inflation and economic struggles.

“Instead of addressing key issues such as inflation and currency depreciation, the BJP is focusing on UCC to cover up its failures,” he told Vibes of India

Doshi referenced the Law Commission’s 2018 rejection of a uniform civil code and questioned its necessity when India already has a Constitution drafted by Dr B R Ambedkar. He urged the government to prioritise a Uniform Service Code and a Uniform Health Code to ensure justice and better healthcare for all citizens.

Doshi further alleged that the BJP has historically used the UCC as a political tool, stating, “During Manmohan Singh’s tenure, a false claim was made that he had reviewed UCC-related documents, but those documents were never presented. The country runs according to the Constitution, and a proper study must be conducted before implementing UCC.”
