IOs To Attend Court When Summoned

Investigation Officers (IO) or policemen who are witnesses in a case not remaining present in the court delays the process of delivery of justice. To avoid this, Gandhinagar police have written to all district officers in the Gandhinagar Range jurisdiction directing IOs of cases, pre and post their postings in Gandhinagar, to remain present in the court whenever a witness summon is issued against them to provide evidence in the court of law.

According to the letter written to all police stations, police officers who are investigation officers or witnesses in cases prior to their postings in Gandhinagar should remain present before the court if they get a witness summons. If not, they would be liable to fine according to CrPC section 350.

The letter also mentions that according to the CrPC and the police manual, section 3 lays down that it is not practical to obtain administrative permission if they have to remain present in the court as an IO or witness.
