A ‘disabled’ man, deemed in an “unfit state of mind” was granted bail by the Gujarat High Court on July 29. The man was accused of raping an eight-year-old girl. As per the accused’s psychiatric evaluation, the court also observed that the man was suffering from “moderate mental retardation”.
The man had been in judicial custody since 2020. Earlier, the trial was stayed by the Gujarat HC in November 2021, as the defence lawyer presented that the man was not capable of putting up a sound defence. The lawyer also said that the accused was “totally disabled and mentally retarded to understand the distinction between the right act and wrong act”.
In an FIR that was lodged at a Surat police station in November 2020, the accused had been charged under IPC sections 377, 506 (2), and under provisions of the Protection of Children from Sexual Offences Act, 2012. During the assault, the accused had allegedly inserted needles in the rectum of the survivor. He had also threatened to kill the child if she informed her parents of the act.
