CBI Appeals for Death Penalty in RG Kar Hospital Rape-Murder Case

The Central Bureau of Investigation (CBI) on Friday filed an appeal before the Calcutta High Court, seeking the death penalty for Sanjay Roy, who was convicted in the RG Kar Medical College and Hospital rape-murder case.

A division bench, presided over by Justice Debangsu Basak and Justice Md Shabbar Rashidi, stated that the CBI’s appeal would be heard on January 27, along with a similar appeal filed by the West Bengal government. The state government is also seeking the admission of its plea for a harsher punishment.

The case pertains to the brutal rape and murder of an on-duty doctor at the RG Kar Medical College and Hospital on August 9 last year. On January 20, the Sealdah court sentenced Roy to life imprisonment till the end of his natural life. The CBI has since argued that the sentence is insufficient, given the gravity of the crime.

Deputy Solicitor General Rajdeep Majumdar, representing the CBI, contended that the agency, which conducted the investigation, holds the right to challenge the trial court’s order before the High Court. 

He described the sentence as inadequate and sought the imposition of capital punishment on Roy.

Meanwhile, Advocate General Kishore Dutta, representing the West Bengal government, also urged the court to impose the death penalty. He argued that the punishment of life imprisonment till death was inadequate for the heinous crime committed by Roy.

The division bench stated that it would hear arguments from the CBI, the West Bengal government, the victim’s family, and the convict’s lawyers before deciding on the matter.

The CBI has also opposed the state government’s right to file an appeal, asserting its position as the prosecuting agency with the exclusive authority to challenge the sentence. The agency emphasised its claim over the right to seek an enhanced punishment.
