“Rarest of Rare Cases”: Prosecution Seeks Death Penalty for RG Kar Convict

Sanjay Roy, convicted in the rape-murder case of a 34-year-old doctor at RG Kar Medical College and Hospital in Kolkata, maintained his innocence in court this afternoon, reiterating that he had been framed. Roy, who was convicted on Saturday by Judge Anirban Das, appeared in court today to address the judge before sentencing. 

The court will deliver the verdict later today, with the minimum sentence being life imprisonment and the maximum possible sentence the death penalty.

Roy addressed the court, stating, “I haven’t done this. I have been framed. Lots of things were destroyed, but if I had done it then my rudraksha mala would have broken. You decide whether I have been framed or not.” 

The judge responded, emphasising the need to deliver justice, saying, “I decide on the basis of the evidence before me. I have heard you as well for three hours. Your lawyer has argued your case. The charges have been proved. Now I want to know your views on the punishment.”

The investigation, initially handled by Kolkata Police, was later taken over by the CBI, which has demanded the death penalty for Roy. The CBI, along with the victim’s parents, has argued that this is a “rarest of rare cases” and that Roy should receive the death penalty. 

Roy’s lawyer cited Supreme Court guidelines on the awarding of the death penalty, prompting the judge to request a list of these guidelines to review before passing his judgment. The court will reconvene at 2.45 pm to announce the sentence.

The court premises in Sealdah have been heavily fortified by police, who are taking extensive precautions to prevent any incidents during the proceedings. Despite the denial of permission, doctors and other individuals have gathered near the court, protesting and alleging that Roy could not have committed the crime alone, demanding that others involved in the crime should also be brought to justice.

The victim’s parents have expressed dissatisfaction with the CBI’s investigation. They allege that other perpetrators were involved in the crime but have not been apprehended. The victim’s mother commented, “Only one person is not involved in the crime, yet the CBI has failed to apprehend the others. Such criminals have no right to live if we are to prevent future crimes in society.”

The 34-year-old doctor, a postgraduate trainee at the hospital, had been working a night shift on the night of the incident. The following morning, her body was discovered in a seminar room of the hospital. The case sparked widespread protests across the country, with doctors suspending work for days in demand of greater safety at work.
