PM-JAY Fraud: Khyati Hospital Chairman Sent to 10-Day Police Custody

Kartik Patel, the chairman of Khyati Multispeciality Hospital and the prime accused in a Rs 16 crore fraud involving the Ayushman Bharat–Pradhan Mantri Jan Arogya Yojana (PM-JAY) scheme, was remanded to 10-day police custody by the Ahmedabad Rural Court on Sunday. Patel, who had been absconding for 65 days, was apprehended on Saturday at Ahmedabad Airport after arriving from Dubai.  

The court granted the remand until 11 am on January 28, following arguments from both the prosecution and the defence. 

The prosecution highlighted 12 key points to justify the remand, including the need to investigate Patel’s financial transactions, identify individuals who facilitated his stay abroad, and examine potential involvement of government officials in the scheme. 

Officials also emphasised the necessity of questioning Patel alongside co-accused individuals such as Dr Sanjay Patoliya. They alleged that Patel controlled all hospital operations and played a central role in the fraudulent activities.  

Patel’s lawyer, Ankit Shah, opposed the remand, arguing that the decision should be based strictly on evidence and case facts. Despite the defence’s objections, the court approved the remand to allow further investigation into the allegations.  

The case originated after two PMJAY beneficiaries, Mahesh Barot, 52, and Nagar Moti Senma, 75, died on November 11 last year following allegedly unnecessary angioplasty surgeries at Khyati Hospital. Their deaths initiated a police investigation, which uncovered widespread misuse of the PM-JAY scheme and led to three FIRs being filed against Patel and others on November 13. 

Charges include culpable homicide, attempt at culpable homicide, and defrauding the PMJAY scheme to generate illicit financial gains.  

Patel is the ninth individual arrested in connection with the case. He is alleged to have left India before the FIRs were filed, travelling to New Zealand, Australia, and finally Dubai. Look Out Circulars were issued against him and other accused. 

Previous arrests in the case include hospital directors Rajshree Pradeep Kothari, Dr Sanjay Mulji Patolia, CEO Rahul Jain, and cardiologist Dr Prashant Vazirani, who performed the disputed surgeries. Investigators have also uncovered the forgery of beneficiary cards, allegedly carried out in collusion with officials from the health department and private contractors linked to the scheme.
